These Terms of Service govern your use of digiBotics (the “Service”), operated by VM6 Networks Ltd (“we”, “us”, “our”), a company registered in England and Wales. By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service.
1. The Service
digiBotics provides AI-powered customer support chatbots that can be embedded on websites and connected to third-party messaging channels. The Service includes website crawling, knowledge-base indexing, conversational AI replies, live operator takeover, and integration with third-party helpdesk platforms.
2. Your account
You must provide accurate registration information and keep your password confidential. You are responsible for all activity on your account. You must be at least 18 years old to enter into this agreement, or have the legal capacity to do so under the laws applicable to you.
One person or entity may not maintain more than one free trial account.
3. Free trial
New Starter accounts include a 14-day free trial. No payment card is required during the trial. At the end of the trial period, your bot will stop responding to customer messages until you subscribe to a paid plan. Your training data, settings, and integrations will be preserved for at least 30 days after trial expiry.
4. Subscription & payment
Paid subscriptions are billed monthly in advance via Stripe. Prices are listed in GBP and are subject to VAT where applicable. We reserve the right to change pricing with at least 30 days’ notice; existing customers will be charged the new rate at the start of their next billing cycle following such notice.
You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of your current billing period; we do not provide refunds for partial months.
5. Acceptable use
You agree not to use the Service to:
- Impersonate another person or entity, or misrepresent your affiliation;
- Train the bot on content you do not own or have permission to use;
- Distribute illegal, harmful, hateful, or sexually explicit content;
- Send unsolicited bulk messages, phishing attempts, or other forms of spam;
- Interfere with the Service, attempt to gain unauthorised access, or probe for vulnerabilities;
- Use the Service to provide regulated advice (medical, legal, financial) without appropriate disclosures and human oversight;
- Resell or sublicense the Service without our written agreement.
We reserve the right to suspend or terminate accounts that violate these rules.
6. AI-generated content
The Service uses large language models to generate responses. While we take reasonable steps to constrain the bot to your trained content, we cannot guarantee that every response will be accurate or appropriate. You are responsible for the responses your bot sends to your customers. We recommend reviewing chat transcripts regularly and using our hard-rules engine (rules.py) for answers that must be exactly correct.
7. Your data
You retain all rights to the content you upload, the URLs you train on, the conversations between your bot and your customers, and any other data you provide. We process this data only to provide the Service. See our Privacy Policy for full details.
8. Our intellectual property
The digiBotics platform, including its software, design, branding, and documentation, is our property. You may not copy, modify, reverse-engineer, or create derivative works without our written permission.
9. Service availability
We aim for 99.5% monthly uptime but do not guarantee uninterrupted access. We may need to perform planned maintenance, which we will announce in advance where possible. We are not liable for downtime caused by third-party services beyond our control (Stripe, DeepSeek, Cloudflare, etc.).
10. Limitation of liability
To the fullest extent permitted by law, our total liability to you for any claim arising from or related to the Service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages including lost profits, lost data, or business interruption.
Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under English law.
11. Indemnity
You agree to indemnify us against claims arising from your misuse of the Service, your breach of these Terms, or content your bot generates that infringes third-party rights or violates applicable law.
12. Termination
You may close your account at any time. We may suspend or close accounts that breach these Terms or are inactive for over 12 months. On termination, your data will be deleted within 30 days unless you have an outstanding balance or legal hold applies.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email at least 14 days before they take effect. Continued use of the Service after that period constitutes acceptance.
14. Governing law
These Terms are governed by the laws of England and Wales. Any dispute will be resolved in the courts of England and Wales, except that consumer customers retain any rights they have under their local consumer protection laws.
